Coldfront — Terms of Use / End User Licence Agreement

1. Agreement

Coldfront ("the Game") is licensed to you, not sold. By downloading, installing or using the Game you agree to these Terms. If you do not agree, do not use the Game.

Our Privacy Policy, at https://playcoldfront.com/privacy, forms part of these Terms. It explains what the Game sends, what stays on your device, and how long anything is kept. Both documents are linked from the Game's Settings › Legal screen. If the two ever disagree about how we handle your data, the Privacy Policy governs.

We may update these Terms — for example to reflect a change to the Game, a change in the law, or a change in how we handle reports. Material changes will be posted on this page with a new "Last updated" date, and the current version is always linked from Settings › Legal. Changes take effect when they are posted and apply only from then on; they do not apply to anything that happened before. If you do not accept a change, stop using the Game — that is your remedy, and deleting it costs you nothing. Continuing to use the Game after a change has been posted means you accept the updated Terms.

2. Who may use the Game

You must be at least 13 years old to use the Game, or 16 where the law of your country sets a higher minimum age for consenting to online services (this includes several countries in the European Economic Area). The Game does not ask your age and has no way to check it — your age is something you declare by using the Game, not something we verify. The Game is not directed at children and we do not knowingly permit users under these ages.

If you believe a child under the minimum age is using the Game, write to support@playcoldfront.com. Because there are no accounts, we cannot identify a particular player or bar them from the Game. What we can do, and will do: delete anything we hold that came from them — in practice a report email, since a display name exists only in a server's memory for the length of one match — stop processing it, and add an offending name to the filter in the next release.

Export and sanctions. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

3. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the Game on any Apple-branded device that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions — except that the Game may also be accessed and used by other accounts associated with you through Family Sharing or volume purchasing. You may not:

All rights not expressly granted are reserved. The Game, its name, artwork, audio and code are owned by us or our licensors. Third-party assets are used under their own licences and are credited in the Game's Settings › About screen.

4. Online play and user content

4.1 What the Game transmits

Online matches are private, friend-code rooms. There is no public gallery, no feed, no matchmaking and no way to browse other people's rooms: a room is reached by entering its code, which you share with the people you want to play with. Codes are short, so treat a room as private to the people you gave the code to rather than as secret. Inside a room:

Treat a display name and a shared map as things you are handing to the other people in the room, not as things you are lending them. Your display name and your custom maps are user content, and you are responsible for them. What each of these means for your personal data is set out in our Privacy Policy.

4.2 Your content, your responsibility

You keep ownership of the maps you create and of the display name you choose.

By sending a display name or a custom map to another player through the Game, you grant:

Copies that outlive the match. The Game automatically records a replay of every match on each player's own device, and a player may also save a match in progress. A replay or a saved game of a match played on a custom map contains a copy of that map, so that it can still be played back later. Those files live only on that player's own device, and deleting the replay or the saved game deletes the copy. A player who reports you also keeps a copy of the report on their own device, and a report about a map contains that map. We cannot delete files from another player's device.

If you receive another player's map this way, you may use it only to play and re-play that match. You must not publish it, redistribute it, share it outside the Game, or host a match with it as if it were your own.

Our licence ends when we stop transmitting the content, except for copies retained as evidence of a report. The licences granted to other players last as long as the copies on their devices do. So: if you would rather not have a map you drew, or a name you chose, end up stored on a stranger's device, do not host an online match with it.

You confirm that you have the right to the content you send and that it does not infringe anyone else's rights. If someone brings a claim against us because of content you sent through the Game, you will cover our reasonable costs of dealing with it, so far as the claim arises from your breach of these Terms. This does not apply where the law of your country does not allow it.

5. Conduct — zero tolerance for objectionable content

We have zero tolerance for objectionable content and abusive users.

You must not use a display name, a custom map, or in-room behaviour that:

Filtering. Display names and custom-map titles are checked against a list of objectionable words before they can be used. A name or title that matches is refused, and you are told why. The same check runs again on your own device on every name that arrives from another player before it is drawn, so a modified client cannot push one past it. We do not pre-screen the terrain imagery inside custom maps — filtering drawn images is not something anyone can do reliably — which is precisely why reporting, blocking and enforcement exist.

Reporting. You can start a report from inside the Game: the REPORT control on a player's row in a lobby, the REPORT control on a shared map, and REPORT A PLAYER OR MAP in Settings. The Game does not send the report for you. It prepares the report — including the offending display name, and for a map report the map itself — keeps a copy on your device, and opens your own email app with the message ready. It only reaches us when you tap Send there, so please check that it actually sent. If your device has no email app set up, the Game puts the report on your clipboard; send it to support@playcoldfront.com any way you like.

Enforcement. We review every report we receive and act on it within 24 hours.

Because rooms have no accounts, here is exactly what acting means. We add an offending display name or map title to the filter that refuses it at the source, so a later release of the Game rejects it. We can stop the relay serving a room, and we can stop operating it for a particular misuse. And we may terminate your licence to use the Game under §7, in which case you must stop using it and delete it. What we cannot do is identify a person across rooms — there is nothing to identify them by. We do not have to warn you first. If you think we got a decision wrong, write to us and we will look at it again.

Blocking. The remedy that works immediately is on your side of the connection. You can block another player from the report sheet in a lobby, and review or undo your blocks in Settings › Blocked Players. Once you block someone, their display name is never shown to you again, any map they share is never drawn on your screen, and a room containing them will not start a match. Blocking takes effect at once, and it ends that room for you: if you joined the room, the Game takes you out of it; if you are hosting it, the room will not start, so leave and host again for a new code. Blocks are stored on your own device and matched on the player's display name — friend-code rooms have no accounts, so someone who changes their name can appear again under the new one. Please report as well as block: a report is what lets us add the name to the filter.

This section describes how we operate the Game's moderation. It is a commitment about our process — that we will look at every report and act within 24 hours — not a warranty that any particular outcome will be reached, that objectionable content will never appear, or that a specific player will be stopped. Sections 8 and 9 apply to it.

6. Availability, the relay we operate, and changes to the Game

Online play depends on a relay server we operate. It is a small service run by one person on a best-effort basis: it may be unavailable, may be restarted (which ends matches in progress), and may be changed or discontinued. Single-player, the campaign, the map editor, saved games and replays do not need the relay and keep working while you have the Game installed.

Other relay servers. Settings lets you point the Game at a relay address other than ours. If you do, your display name, any map you host and your gameplay commands go to whoever operates that server. We do not run it, we have no visibility of it, we do not endorse it, and nothing in these Terms or in our Privacy Policy applies to it — including anything in §5 about filtering, reporting or enforcement, which we cannot perform on a server we do not control. You use another operator's relay entirely at your own risk. Do not change the address unless you know who is running the server at the other end.

Saved games and replays. They are tied to the version of the Game that produced them. We try hard to keep them working across updates, and the Game tells you when a replay was recorded on an older version — but a future update may change how a match is simulated, in which case an old replay may play back differently, or a very old file may no longer open. If a particular recording matters to you, do not rely on us to preserve it.

Changes to the Game. We may update the Game — to fix problems, to keep it working on new devices and operating systems, for security, or to improve or rebalance it. An update may change how the Game behaves, and may add, change or remove a feature. Where a change would materially affect a feature you rely on, and it is not a fix or a security or legal necessity, we will say so in the update's release notes; if you do not want the change, you do not have to install the update, and you may stop using the Game at any time. We may also stop publishing or supporting the Game altogether.

We do not guarantee that the Game will be uninterrupted or error-free.

7. Termination

You may stop using the Game at any time by deleting it. We may suspend or terminate your licence immediately if you breach these Terms, in particular §5. On termination your right to use the Game ends and you must delete it; sections 3 (reservation of rights), 4.2, 8, 9, 10, 11, 12, 13 and 14 survive.

8. Disclaimers

Except for the moderation commitment we make in §5, and to the maximum extent permitted by law, the Game is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you, and you may have rights that these Terms cannot limit.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising out of your use of the Game. Our total liability for any claim relating to the Game will not exceed the greater of the amount you paid for the Game in the twelve months before the claim, or USD 50.

Nothing in these Terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for gross negligence or wilful misconduct.

If you are a consumer in the United Kingdom or the European Economic Area, nothing in these Terms affects your statutory rights — including your rights in respect of digital content under the Consumer Rights Act 2015 and your statutory conformity rights under EU law — and the limits above apply only so far as the law of your country of residence allows. Some jurisdictions do not allow these limitations, so parts of this section may not apply to you.

10. Other players — their content and their conduct

Custom maps and display names created by other players are theirs, not ours, and so is how other players behave towards you. We do not control other players, we are not a party to any dispute between you and another player, and we do not mediate them. Playing online means interacting with people we have not vetted and cannot vouch for. To the maximum extent permitted by law, we are not liable for the content another player sends you, for their conduct in a room, or for any loss arising from your dealings with them.

If you encounter something objectionable, block the player and report it. Both are described in §5.

12. Governing law and disputes

These Terms are governed by the laws of the State of California, United States, excluding its conflict-of-law rules. Any dispute arising out of them may be brought in the state or federal courts located in the State of California.

If you are a consumer, this does not take away the protection of the mandatory consumer-protection law of the country where you live, and you may also bring proceedings in the courts of that country.

13. Copyright and takedown

If you believe content sent through the Game infringes your rights, email support@playcoldfront.com with:

We act on takedown requests within 24 hours. If your content was affected and you believe that was a mistake, reply to us and we will look at it again.

14. General

If any part of these Terms is found to be unenforceable, that part falls away and the rest still applies. These Terms, together with our Privacy Policy, are the whole agreement between you and us about the Game. Where the Game itself explains how filtering, reporting or blocking work, that explanation is a summary of §5 and does not add to or replace it; if the two differ, §5 governs. If we do not enforce a right straight away, we have not given it up. You may not transfer these Terms to anyone else; we may transfer them to whoever takes over the Game. Neither of us is responsible for a failure caused by something outside our reasonable control.
